Sec. B17-1. Applications for vacation or abandonment of right-of-way or public service easement.

(a) Filing fee required. Every petition or application for the vacation or abandonment of all or any part of a County highway right-of-way or public service easement shall be accompanied by a filing fee in the amount of $1,200.00 to defray the expense of investigations, publications and postings. In the discretion of the County Board of Supervisors, such application fee chargeable to a city, special district or other public agency, or any portion thereof, may be waived by the Board.

(b) Deposit of fee. The aforementioned fee must be deposited with the appropriate County agency by the applicant or petitioner prior to commencement of any proceedings on the petition or application. If the applicant is a city, special district or other public agency, the applicant shall tender the required fee to the proper County agency. If in the discretion of the Board the fee, or any portion thereof, is thereafter waived, the amount of the fee or portion thereof waived by the Board shall be returned to the city, special district or other public agency. No city, special district or other public agency granted a waiver of fee or any portion thereof shall be entitled to interest on any such funds deemed waived and returned to it.
