Employers do not have to take the total deduction from a single paycheck. They can deduct the payments over all pay periods in a month.
- You are allowed to charge $1.00 for each deduction. Please let your employee know if you take this deduction.
- Remember that the deduction is to be made from "disposable" earnings, which is different from gross earnings, or take-home pay. Disposable earnings are what remains after required state and federal taxes, social security, state disability, and mandatory payments to employee retirement plans are deducted.
- Do not withhold more than 50 percent of disposable earnings unless the court instructs otherwise.
When DCSS has information that the person is no longer your employee, DCSS will send you a notice and the wage assignment; fill out the notice and return it to us. We suggest you keep the wage assignment for a year in case the person returns. If you have questions, write the questions on the notice and fax us at 408-503-5319.
