The State of California has implemented SB 1396, which has amended Government Code section 27388 regarding the Real Estate Fraud Fee. The Real Estate Fraud fee increased from $2.00 to $3.00. The Real Estate Fraud Fee now applies to recording and re-recording additional document types. This is now the full list of document types subject to the Real Estate Fraud Fee starting January 1, 2009:

- Assignment of Deed of Trust
- Substitution of Trustee
- Reconveyance
- Request for Notice of Default / Notice of Rescission
- Notice of Default
- Notice of Trustee Sale
- Notice of Rescission of Declaration of Default
The California Environmental Quality Act (CEQA) filing fees also increased on January 1, 2009. The Notice of Determination - Negative Declaration Fee increased to $1,993.00. The Notice of Determination - Environmental Impact Report Fee increased to $2,768.25.
