CHAPTER XI.
CITIZENS' ADVISORY COMMISSION ON ELECTIONS

Sec. A6-140. Establishment.

There is hereby established, in accordance with Sections 500 and 506 of the Charter, a Citizens' Advisory Commission on Elections.

Sec. A6-141. Membership.

The Commission shall consist of five members, each of whom shall be representatives of the five County supervisorial districts appointed by each Supervisor. The Board of Supervisors may also establish two additional at-large commissioners, whose positions shall be filled by rotating the "right of nomination" among the supervisorial districts, for a maximum of seven members.

Each Commissioner shall have a term of three years, except that two of the initial five members, who shall serve two-year terms, and a third one shall serve a one-year term. The initial reduced terms shall be decided by the drawing of lots at the first regularly scheduled meeting of the Commission.

No member shall be eligible to serve on the Commission for more than three consecutive terms in addition to any portion of an unexpired term which may have been served. A vacancy shall exist and shall be reported to the Board of Supervisors whenever a Commissioner fails to attend more than three consecutive regular meetings of the Commission without good cause entered into the minutes.

Sec. A6-142. Organization.

The Commission shall organize itself in accordance with Section 506 of the Charter. It shall establish bylaws, or rules of conduct, subject to approval by the Board of Supervisors; and the Clerk of the Board of Supervisors shall be ex officio secretary of the Commission and shall provide secretarial assistance to the Commission. The Registrar of Voters, or his or her designee, shall attend meetings and provide available data for the commission to do its work in accordance with "Roles of the Departments/Agencies and Staff" in the Boards and Commissions Handbook.

As soon as practicable upon formation, and every July 1 of every year thereafter, the Commission will organize by electing one of its members as chairperson and another as vice chairperson to serve at the pleasure of the Commission. A majority of a five-member Commission shall consist of three Commissioners, and a majority of a seven-member Commission shall consist of four members, each of which constitutes a quorum for the transaction of business.

Sec. A6-143. Meetings of the Commission.

Notwithstanding the provisions of Section A6-3, the Commission shall meet monthly, as a six-month pilot program, on the first Tuesday of the month. The monthly meeting schedule shall be reviewed by the Board at the conclusion of the six-month pilot program. The time and place of each meeting shall be specified in the notice calling the meeting. All meetings shall be open to the public and shall be subject to the Ralph M. Brown Act, Government Code, Section 54950 et seq., relating to meetings of local agencies.

Sec. A6-144. Duties.

The Commission shall act in an advisory capacity to the Board of Supervisors and the Registrar of Voters with respect to:

(a) Promoting the integrity, efficiency and accuracy of voter registration and election processes.

(b) Encouraging the widest possible citizen participation in elections, including attending to the particular needs of new citizens and ensuring bilingual needs are met.

(c) Promoting voter education and outreach.

(d) Providing appropriate and timely information and advice to the Board of Supervisors and Registrar of Voters through the Finance and Government Operations Committee of matters related to (a) through (c).

(e) Submitting an annual work plan to the Board of Supervisors through the Finance and Government Operations Committee for consideration in May and final approval by the Board of Supervisors in June.

Sec. A6-145. Expenditures.

No expenditures or requisitions for services and supplies for Commissioners shall be made, and no claims for reimbursement shall be submitted for payment, unless necessary to the conduct of the Commission's business. All expenditures and approvals must be approved by the Clerk of the Board, who shall be responsible for preparing and processing all expenditures, requisitions and claims.

Sec. A6-146. Review of the Commission.

The Commission shall submit a report to the Board of Supervisors through the Finance and Government Operations Committee every two years, on or before June 30. The first report shall be submitted on, or before, June 30, 2010. The report shall be filed pursuant with Chapter XII of Division A6 of the Santa Clara County Ordinance Code.
