Sec. A9-1. Repair, replacement of uniforms, clothing, equipment.

(a) The County shall pay the cost of repairing or replacing the uniforms, clothing and equipment of County employees which have been damaged, lost or destroyed in the line of duty when the following conditions exist:

(1) The clothing, uniform or equipment is specifically required by the department or necessary to the employee to perform his or her duty; clothing and uniforms necessary shall be those which are specifically required by the employee's duties, and not adaptable for continued wear to the extent that they may be said to replace the employee's regular clothing; or

(2) The clothing, uniform or equipment has been damaged or destroyed in the course of making an arrest, or in the issuance of a citation, or in the legal restraint of persons being placed in custody or already in custody, or in the service of legal documents as part of the employee's duties or in the saving of a human life; and

(3) The employee has not, through negligence or willful misconduct, contributed to such damage or destruction of said property.

(b) Claims for reimbursement shall be reviewed and approved by the County Executive, or his or her designee, in accordance with the procedures set forth by County Executive.

(c) The County Executive, or his or her designee, may adopt reasonable rules and regulations for the administration of this section.

Sec. A9-2. Reserved.

Editor's note--Ord. No. NS-300.167, §§ 2, 3 and 5, adopted Aug. 5, 1972, repealed former § A9-2 derived from Code 1954, §§ 3.6.2-1 and 3.6.2-2, and Ord. No. 300.33.1, § 1, adopted April 20, 1959. Said former § A9-2 pertained to the repairing and replacing of property of County employees lost, damaged or destroyed while saving lives and apprehending escapees.

Sec. A9-3. Applicability of provisions to Sheriff's Reserve.

The County shall pay the same cost for uniforms and property in the same manner and under the same conditions as are authorized for County employees under this division for members of the Sheriff's Reserve while acting under the authority of the Sheriff for and on behalf of the County.
