OFFICE OF PRETRIAL RELEASE SERVICES*

Editor's note--Ord. No. NS-300.246, § 1, adopted May 31, 1977, specifically amended the Code by repealing Div. A28, §§ A28-1--A28-4, which had pertained to the Public Administrator and Guardian. Said sections had been derived from Code 1954, §§ 3.1.15-1, 3.1.15-2; Ord. No. NS-300.30, § 1, 3-17-58; and Ord. No. NS-300.63, § 1, adopted July 9, 1962. Subsequently, Ord. No. NS-300.340, adopted June 2, 1981, enacted a new Div. A28, §§ A28-1--A28-5.

Sec. A28-1. Office recognized.

There is in the County an Office of Pretrial Release Services, hereafter in this division referred to as the Office.

Sec. A28-2. Office of Pretrial Release Services Director.

There is in the Office the position of Director, who is the Director of the Office.

Sec. A28-3. Appointment of Director.

The Director shall be appointed by the County Executive in accordance with the provisions of the Charter. The Director is the executive officer of the Office and is under the supervision of the County Executive.

Sec. A28-4. Director's authority over personnel.

Subject to the provisions of the Charter and this Code, the Director shall have power to appoint, supervise, suspend or remove all assistants, deputies, clerks and other employees in the Office.

Sec. A28-5. Director's powers.

The Director shall have administrative control over the Office and shall be responsible for the preparation of the budget. The Director shall effect the pretrial release of criminal defendants, as authorized by state law or the Judges' Joint Committee, and shall do whatever is necessary to improve the effective and efficient processing of such defendants.

Sec. A28-6. Fees.

The Office of Pretrial Services is authorized to charge and collect fees for various services as established by resolution approved by the Board of Supervisors and amended from time to time.

Sec. A28-7. Waiver and reduction of fees.

The Director of the Office of Pretrial Services, or his or her designee, may waive or reduce fees provided for in this chapter where in the judgment of the Department, payment of fees would present a hardship for the individual.
