CHAPTER II.
HANDBILLS

Sec. B1-11. Scope of regulations.

The provisions of this chapter apply only to printed matter which is primarily for the purpose of advertising as distinguished from literature, newspapers, magazines, or other publications which are published primarily for news or entertainment purposes. This chapter shall not apply to any printed matter primarily in the nature of protest or opinion literature.

Sec. B1-12. Permit required.

No person shall distribute or deliver any handbills, dodgers, circulars or other advertising matter as defined herein without first obtaining a permit from the Sheriff to do so.

Sec. B1-13. Permit application.

Written application for a permit required by this chapter shall be filed with the Sheriff and shall contain the following information:

(a) Name of applicant.

(b) Occupation.

(c) Business status.

(d) Residence address.

(e) The type and nature of the advertising sought to be distributed together with a copy thereof, a drawing, or other descriptive material.

(f) The names and addresses of employees, partners, or agents to be engaged in distributing advertising matter.

(g) The manner in which distribution is proposed to be made.

(h) The time during which the described matter will be distributed.

Sec. B1-14. Permit issuance, denial.

The Sheriff shall issue a permit to every applicant requesting one within two days, not including Saturdays, Sundays and holidays, of receipt of the application and all required information, except where it appears to the Sheriff that the proposed distribution would result in the violation of any law, including California Penal Code § 311.1.

Sec. B1-15. Scope of permit.

The permit shall authorize the distribution or delivery of handbills, dodgers, circulars or other advertising matter for the period specified in the permit but not to exceed six months. The person to whom the permit is issued, his agents, partners and employees, shall be authorized to distribute or deliver advertising matter pursuant to such permit. No person whose employer, principal or partner has no permit, or who has no permit himself, shall distribute or deliver advertising matter.

Sec. B1-16. Permit revocation.

Permits may be revoked by the Sheriff when he finds any permittee or his employee, agent or partner distributing material which violates any law or applicable ordinance. A permit may be revoked when advertising matter is distributed by a permittee which is substantially different from that described in the application and permit. Three permit revocations may be grounds for denial of any application for a permit whether such application is made by an individual, his partner, agent or employee.

Sec. B1-17. Appeals.

An appeal from the decision of the Sheriff to deny or revoke any permit may be made to the Board of Supervisors upon filing a written notice of appeal with the County Executive within five days of the action of the Sheriff complained of. Such notice shall specify the basis of the appeal and shall include a copy of the advertising matter attached to the appeal.
