Sec. B8-1. Exemption from Solar Shade Control Act.

The unincorporated lands of the County of Santa Clara which are under the custody and control of Midpeninsula Regional Open Space District, a special district, or the Santa Clara County Open Space Authority, a special district, are protected lands held in trust for the people of the County of Santa Clara, and are exempt from the provisions of the Solar Shade Control Act which provides that any person, including a public entity or special district, owning or in control of property shall take action to remove or alter trees or shrubs which cast shadows that interfere with a solar collector or other solar energy device of any property owner. This ordinance is enacted pursuant to Public Resources Code § 25980 et seq., and is in addition to the exemption pertaining to those lands under the custody and control of the Director of the Department of Parks and Recreation and pursuant to B14-23.5.
