CHAPTER I.
IN GENERAL

Sec. B17-1. Applications for vacation or abandonment of right-of-way or public service easement.

(a) Filing fee required. Every petition or application for the vacation or abandonment of all or any part of a County highway right-of-way or public service easement shall be accompanied by a filing fee in the amount of $1,200.00 to defray the expense of investigations, publications and postings. In the discretion of the County Board of Supervisors, such application fee chargeable to a city, special district or other public agency, or any portion thereof, may be waived by the Board.

(b) Deposit of fee. The aforementioned fee must be deposited with the appropriate County agency by the applicant or petitioner prior to commencement of any proceedings on the petition or application. If the applicant is a city, special district or other public agency, the applicant shall tender the required fee to the proper County agency. If in the discretion of the Board the fee, or any portion thereof, is thereafter waived, the amount of the fee or portion thereof waived by the Board shall be returned to the city, special district or other public agency. No city, special district or other public agency granted a waiver of fee or any portion thereof shall be entitled to interest on any such funds deemed waived and returned to it.

Sec. B17-2. Cleated vehicles prohibited.

No person shall drive, operate, tow or otherwise transport any cleated vehicle on, upon or across any County highway in a manner which permits or causes the cleats of such said vehicle to come into contact with the paved portion of said highway.

Sec. B17-3. Depositing dirt, rocks, debris on County highways--Prohibited.

No person shall place, deposit or dump, or cause to be placed, deposited or dumped, any dirt, rocks, gravel, mud or any other objects of any nature or description on the traveled portions of any County highway.

Sec. B17-4. Same--Removal by the Director of the Transportation Agency.

The Director of the Transportation Agency may remove any such dirt, rocks, gravel, mud or any other objects of any nature or description from the traveled portions of any County highway, and the person, or the principal or employer of said person, causing such dirt, rocks, gravel, mud or any other objects to be placed, deposited or dumped on such County highway shall be liable to the County for any expense in connection with the removal thereof.

Sec. B17-5. Same--Provisions supplementary to state laws.

The provisions of Sections B17-3 and B17-4 are not intended to conflict with but shall supplement all the laws of the State relative to the obstruction of public highways.

Sec. B17-5.1. Semitrailer trucks prohibited on State Highway 152.

Trucks over 45 feet in length are hereby prohibited from the section of State Highway 152 in the unincorporated area of Santa Clara County between Gilroy city limits and the Santa Cruz County line in accordance with the provisions of the California Vehicle Code § 21101(c). Trucks are hereby defined as tractor-trailer combinations with a total length of 45 feet. The designated alternate route for vehicles prohibited on Highway 152 shall be Highway 129.

Sec. B17-5.2. Exemptions.

An exemption to the aforementioned truck prohibition [Section B17-5.1] is hereby granted to trucks, including logging trucks, to enter the restricted area for the purpose of providing services, making pickups or deliveries of goods, wares and merchandise, or delivering construction materials to sites within the restricted segment that have no other means of access, while actually involved in and transacting such activities.

Sec. B17-5.3. Trucks with gross weight in excess of 9,000 pounds prohibited on State Highway 85.

The maximum gross weight of vehicle and load on State Highway Route 85 from State Highway Route 280 in the City of Cupertino south and east to State Highway Route 101 in the City of San Jose is 9,000 pounds per truck or per truck and full trailer or semitrailer combination. State Highway Routes 17, 101 and 280 are hereby designated as alternate routes for the use of such vehicles that are prohibited the use of Route 85.

Sec. B17-5.4. Exceptions.

The following shall be excepted from the vehicular weight restriction imposed by Section B17-5.3: Police and Fire Department vehicles, passenger buses, recreational vehicles, and utility vehicles which need to enter the area for the purpose of providing services, making pickups or deliveries of goods, wares and merchandise, or delivering construction materials to sites within the restricted highway segment and have no other means of access, while actually involved in and transacting such activities.

Sec. B17-5.5. Length limits on Bear Creek Road.

The following length limits shall apply to Bear Creek Road from Highway 17 to Skyline Boulevard:

(1) Two or three axle semi-trailers shall be limited to a maximum kingpin to rear most axle measurement of 38 feet.

(2) A combination of vehicles coupled together, including any attachments, shall be limited to a total maximum length of 60 feet.

Sec. B17-6. Length limits on San Antonio Valley Road.

The following length limits shall apply to San Antonio Valley Road from the end of State Highway 130 to Isabel Bridge:

(1) Two or three axle semitrailers shall be limited to a maximum kingpin to rearmost axle measurement of 38 feet.

(2) A combination of vehicles coupled together, including any attachments, shall be limited to a total maximum length of 60 feet.

Sec. B17-7. Length limits on Calaveras Road, Sierra Road and Felter Road.

The following length limits shall apply to Calaveras Road from 0.28 miles westerly of Weller Road to the County line, Sierra Road from 0.15 miles westerly of Skyview Drive to Felter Road, and Felter Road from Sierra Road to Calaveras Road:

(1) Two- or three-axle semitrailers shall be limited to a maximum kingpin to rearmost axle measurement of 38 feet.

(2) A combination of vehicles coupled together, including any attachments, shall be limited to a total maximum length of 60 feet.

Sec. B17-9. Weight limit of Bridge No. 93003-2.38 on Aldercroft Heights Road crossing Los Gatos Creek.

The maximum gross weight of vehicle and load on Bridge No. 93003-2.38 (37C-508) on Aldercroft Heights Road crossing Los Gatos Creek is 19 tons per vehicle, 29 tons per semitrailer combination and 34 tons per truck and full trailer.

Sec. B17-10. Weight limit on Bridge No. 93003-2.10 on Aldercroft Heights Road crossing Hooker Creek.

The maximum gross weight of vehicle and load on Bridge No. 93003-2.10 (37C-506) on Aldercroft Heights Road crossing Hooker Creek is 17 tons per vehicle, 25 tons per semitrailer combination, and 34 tons per truck and full trailer.

Sec. B17-11. Weight limit on Bridge No. 93003-2.12 on Aldercroft Heights Read crossing Los Gatos Creek.

The maximum gross weight of vehicle and load on Bridge No. 93003-2.12 (37C-507) on Aldercroft Heights Road crossing Los Gatos Creek is nine tons per vehicle, 14 tons per semitrailer combination, and 17 tons per truck and full trailer.

Sec. B17-13. Weight limit of Bridge No. 94001-0.58 on Bertram Road crossing Alamitos Creek.

The maximum gross weight of vehicle and load on Bridge No. 94001-0.58 (37C-515) on Bertram Road crossing Alamitos Creek is 13 tons per vehicle, 20 tons per semitrailer combination, and 25 tons per truck and full trailer.

Sec. B17-14. Weight limit on Westboro Drive between Capitol Avenue and White Road.

The maximum gross weight of commercial vehicles on Westboro Drive between Capitol Avenue and White Road is 14,000 pounds (seven tons). The designated alternate route is Story Road and Alum Rock Avenue.

Sec. B17-16. Weight limit and speed limit on Bridge No. 07015-6.66 on Gilroy Hot Springs Road crossing Coyote Creek.

The maximum gross weight of vehicle and load on Bridge No. 07015-6.66 (37C-539) on Gilroy Hot Springs Road crossing Coyote Creek is 13 tons per vehicle, 20 tons per semitrailer combination, and 26 tons per truck and full trailer. The maximum speed limit on said bridge is five miles per hour.

The maximum gross weight of commercial vehicles traveling over, upon or across the following roadways in the County is 12 tons:

Sec. B17-17.17. Weight limit on Old Alviso Road crossing Coyote Creek.

The maximum gross weight of vehicle and load on Bridge No. 37C-556 on Old Alviso Road crossing Coyote Creek is 22 tons per vehicle, 29 tons per semitrailer combination, and 32 tons per truck and full trailer. The maximum speed limit on this bridge is 25 miles per hour.

The maximum gross weight of vehicle and load on Bridge No. 37C-505 on Alamitos Road crossing Herbert Creek is six tons per vehicle, eight tons per semitrailer combination, and ten tons per truck and full trailer.
