Pretrial Services Drug Testing


Pretrial Services provides drug/alcohol testing for defendants released on Supervised Own Recognizance. The testing results are used as a means to monitor the defendant’s compliance on Pretrial release. Continued drug/alcohol use is reported to the Court which could result in additional sanctions or a return to custody.

Release conditions, including drug/alcohol testing, are court ordered by Court. Drug/alcohol testing is conducted on a random basis. Pretrial Services follows a strict "chain of custody" process and a gender specific staff person observes the collection of the specimen. There is a cost associated with drug/alcohol testing.

Prop. 36 Drug Testing
 
 
Pretrial Services also provides drug/alcohol testing for defendants sentenced to Proposition 36 (Prop. 36).  The testing results are used as a means to monitor the defendant’s compliance on Prop. 36.  The defendant is ordered for Prop. 36 testing by the Santa Clara County Superior Court and the results are sent to the Santa Clara County Probation Department. 
 
Prop. 36 drug/alcohol testing is conducted on a random basis. Pretrial Services follows a strict "chain of custody" process and a gender specific staff person observes the collection of the specimen. There is no cost associated with Prop. 36 drug/alcohol testing.
