In Person
If filing your notary bond and oath with the County Clerk's office in person, you must take and file your oath of office and notary bond within 30 calendar days of your commission's starting date. Please come to the Business Division at our main office between the hours of 8:00 AM and 4:30 PM. Bring the following items with you:
original bond of $15,000, issued by a surety company of your choice
two completed and unsigned oath of office forms
identification
cash, check or money order to cover the filing fee
The filing fee is $63.00 (this fee includes the $10.00 Real Estate Fraud Prevention Fee per GC 27388) for a one-page bond. Add $3.00 for each additional page, if any. The fee includes the cost of recording your bond. The Clerk's Office will verify the documents, administer the oath, then forward the bond to the County Recorder for recording. Within three to four weeks, the recorded bond will be returned to you by mail.
By Mail
If planning to have your notary bond and oath processed by mail, take the following items with you to a Notary Public:
- two completed and unsigned oath of office forms
identification
Notary's fee
The oath must be executed before a Notary Public in Santa Clara County. Then forward the following items with a short cover letter to the Clerk's Office by certified mail. Be sure to send them early enough for us to receive the items within the 30 calendar day filing period.

check or money order to cover the filing fee made payable to Clerk-Recorder's Office
short cover letter with name, address and telephone number

The fee includes the cost of recording your bond. Be sure to sign the bond. The return name and address for the bond must be typed or printed in the top left corner of the bond. The two completed oath of office forms must be signed by the applicant, and the Notary Public who administered the oath must complete the "For Persons Filing by Mail" section.

The Clerk's Office will verify the documents, then forward the bond to the County Recorder for recording. Within three to four weeks, the recorded bond will be returned to you by mail.
