Overview   A psychological evaluation for a parent or child must be ordered by the Court. Social workers may recommend that a client undergo a psychological evaluation at a scheduled hearing or through an Ex Parte Application. If a hearing is scheduled soon after the social worker assesses the need for a psychological evaluation, the recommendation for the psychological evaluation is added to the Court Report recommendations. If in between scheduled hearings an assessment is made that the case would benefit from having the parent or child undergo a psychological evaluation, a recommendation to the Court may be submitted on an Ex Parte Application.

Following are instructions to initiate the referral either at a scheduled hearing or through an Ex Parte Application.

Recommending a Psychological Evaluation at a Scheduled Hearing  

To recommend a psychological evaluation at a scheduled hearing, prior to the hearing, the social worker:

  1. Completes Section I of the Referral for Juvenile Dependency Court-Ordered Psychological Evaluation SCZ 1671(c).

  2. Faxes or mails a copy of the SCZ1671(c) to the attorneys for the child and the parents and to County Counsel and asks for a response within 48 hours.

  3. Receives responses from all parties as to agreement or disagreement regarding the request and the proposed questions.
    • If agreement can not be reached regarding the questions, then the matter must be resolved in court.

  5. In the Court report to be submitted for the hearing, adds a discussion of the psychological evaluation, including:
    • The reasons for recommending the evaluation.
    • Who was noticed.
    • How they were noticed.
    • When they were noticed.
    • The response from each party noticed, including the basis for any disagreement, if known.
  6.  
  7. Notices the parties to the hearing of the recommendation for the psychological evaluation.
    • Continuing social workers are able to give Notice by using the green noticing sheet, Noticing Information for Review Hearing (SC1423), which are generated by the DI Control Clerk.
      • Under Section 5. Hearing Recommendations and Identified Issues, check “Psychological Evaluation of:” and place a checkmark by the person to be evaluated.
    • DI and continuing social workers, if the continuing social worker does not indicate the recommendation on the SC1423, complete the Declaration Re: Notice of Ex Parte Application (SCZ 170) and attach it to the SC1671(c).
  8. Takes the completed SCZ 1671(c) to the court hearing and has the judge/commissioner sign the form.
    • The SCZ 1671(c) with original signatures is retained in the legal file, and an endorsed copy is sent back to the social worker.

To recommend a psychological evaluation through an Ex Parte Application, the social worker:

  2. Faxes or mails a copy of the SCZ 1671(c) to the attorneys for the child and the parents and to County Counsel and asks for a response within 48 hours.

    • If agreement can not be reached regarding the questions, then the matter must be resolved in court.

  4. Completes the Declaration Re: Notice of Ex Parte Application (SCZ 170) and attaches it to the SC1671(c).

  5. Sends the SCZ 1671(c) to court services for processing.
    • The original of the signed SC 1671(c) is retained in the legal file and the endorsed copy is sent back to the social worker.

Non Reunification (Bypass) Evaluations   Non Reunification (Bypass) Evaluations :

Before submitting a referral for psychological evaluations in order to recommend bypass of Family Reunification services to a family, the request must be approved by the DFCS Director.

Instructions for Use of the SCZ 1671(c)   Instructions for the use of the SCZ1671(C):
  • SECTION I -REQUEST FOR EVALUATION
    • Recommendation at a Scheduled Hearing
    • Recommendation through an Ex Parte Application
    • Non-reunification (Bypass) Evaluations


  • SECTION II-COURT APPROVAL
    • The Court will:
      • Review request.
      • Approve, modify, deny request, or set for hearing.
      • Return signed form to requesting party.


  • SECTION III-REFERRAL TO COORDINATOR
    • The Requesting Party will:
      • Complete Section III of the SCZ 1671 (c).
      • Attach appropriate reports and documents listed on the SCZ1671(c).
      • Complete and attach an original SCZ 414Z payment request form signed by supervisor for payment of the evaluation.
      • Forward by pony packet to Evaluation Coordinator.  
        • Anelda Qualtieri is currently the Coordinator. She can be reached at 408-975-5285. She is generally available on Tuesdays and Thursdays, and is located on the 5th Floor, 373 W. Julian Office. 
    • For Non-Reunification Bypass Evaluations, attach two (2):
      • Copies of the SCZ1671 referral form, one for each evaluation.
      • Original Special Fund Requests (SCZ 414Z) forms signed by supervisor.
      • Sets of reports and documents listed on the SCZ1671(c).

  • SECTION IV-APPOINTMENT OF EVALUATOR
    • The Evaluation Coordinator will:
      • Review the packet.
      • Confer with requesting party, if needed.
      • Select evaluator(s).
      • Complete and sign Section IV.
      • Notify the social worker in writing of the assigned evaluator.
      • Forward a copy of the SCZ-1671(c) referral form, packet and protocol to the selected evaluator(s).
      • Schedule an appointment for the client directly with the evaluator.
      • Submit the completed report and invoice to the coordinator for review and approval.
      • Forward the evaluation report to the requesting party, and will submit the SCZ 414Z and the invoice for necessary action and payment.
     
    • The Social Worker will:
      • Assist with facilitating appointments when necessary. 
      • Immediately distribute the completed evaluation report to all counsel of record.
