File 11439 - Community Preservation Ordinance
+

In order to protect the public from health and safety hazards and the harm to property values that result from the neglect and deterioration of property, and to preserve the livability, appearance, environment, and social and economic stability of unincorporated Santa Clara County (County), the County is considering adoption of a Community Preservation Ordinance.

The proposed Community Preservation Ordinance will address urban property blight in unincorporated County lands and the scope of its application will be limited to privately-owned properties in Urban Residential or Commercial base districts as defined in County Zoning Ordinance.

Conditions identified as constituting property blight in the Community Preservation Ordinance include, but are not limited to the following:

  • Unsecured buildings and abandoned buildings and structures
  • Abandoned construction
  • Conditions that pose dangers to public health or safety, such as abandoned wells, if they are accessible to unauthorized persons due to inadequate security
  • Building or structure in a state of disrepair such as broken windows, doors, or fences; and deteriorating walls or roof coverings.
  • Overgrown or decayed trees or vegetation creating potential for fire hazards, harboring infestations, or substantially detracting from the aesthetic and property values of neighboring properties.
  • Graffiti
  • Unlawfully stored or accumulated garbage and refuse
  • Impermissible outdoor storage such as a shipping container stored outdoors
  • Storing, dismantling, or maintaining vehicles in violation of the existing Zoning Ordinance restrictions

The County has scheduled two public meetings to provide information and solicit feedback and comments relating to the proposed Community Preservation Ordinance. Details of the public meetings below:

Environmental Review

As the Lead Agency, the County of Santa Clara will prepare an Environmental Impact Report (EIR) for the Z-Best Compost Facility Modifications Project, which is described in the Notice of Preparation (NOP).

 

A Public Scoping Session to solicit comments for the NOP will be held at the Gilroy Library, 350 W. 6th Street, Gilroy on Tuesday, October 30 from 6:30 p.m. to 8:00 p.m. In accordance with the California Environmental Quality Act (CEQA), comments on the NOP must be received within 30 days of receipt of this notice. Written and/or email comments on the NOP should be provided to the County at the earliest possible date, but must be received by 5 p.m. on November 16, 2018.

File 9555 - Shamrock Seeds Project

The County has released the Final Environmental Impact Report (EIR) for the Shamrock Seeds Project. The EIR and project approval are scheduled to be considered by the Board of Supervisors on February 26, 2019.

Description:

The project proposes the demolition of existing on-site greenhouses totaling approximately 14,433 square feet (the existing modular office structure, barn, and equipment shed would remain) and construction of a new 10,000-square-foot agricultural research building, parking lot, and two sets of greenhouse structures (measuring approximately 100 feet by 130 feet, and 85 feet by 300 feet). The greenhouses would be internally illuminated during a portion of non-daylight hours. A 90-squarefoot electrical utility building, 40,000-gallon above-ground water tank, and stormwater detention pond would also be constructed.

Since the subject property is located on Holsclaw Road, a County maintained road, and in close proximity to an intersection with Hwy 152, a State Highway, the California Department of Transportation (Caltrans) may require an encroachment permit to review the Traffic Control Plan (TCP) to avoid any project-related impacts to the State Transportation Network.

The existing agriculture research facility was granted ASA approval in 2007 for its current establishment. The proposed 10,000 research building and greenhouses are intended to consolidate existing research facilities and to provide the environment necessary to conduct seed-related specific experiment activities. The proposed project would not include any increase in the number of existing employees and / or any intensification of the existing operation.

PLN18-11418 - Gilroy Rodeo Use Permit, Grading Abatement, and Williamson Act Compatible Use Determination

Description:

The project applicant seeks Use Permit approval to re-establish the Gilroy Rodeo as one (1) large event and one (1) medium events on an annual basis. Proposed infrastructure includes a 320’ x 150’ main arena, a 96’x57’ pen, a 100’ x 100’ warmup arena, buck pens, bucking chutes, roping chutes, loading ramp, announcer’s booth, livestock shade structures, light poles, and an office trailer. Other improvements include adjacent parking areas, amplified sound system, ancillary overnight RV parking for out of area contestants, and pens for stabling of event live stock. The applicant is also seeking approval for 17-rows of seating constructed on an earthen berm around the rodeo arena.

The proposed annual large events would have up to 6,500 spectators, 500 contestants and 30 volunteers at any one time and would last for 3-5 days per event. The proposed medium events, such as large jackpots, would have up to 2500 spectators and contestants, and 100 volunteers per day and would last for three days per event.

Once the application has been deemed completed, the County Planning Division will schedule a public outreach meeting, conduct environmental review as required under the California Environmental Quality Act, and then schedule the Use Permit for a hearing before the County Planning Commission.

The proposed project is to apply for a USE PERMIT to allow a place of assembly and worship for Dae Seung Sa Korean Buddhist Temple. (The Temple. The project proposes four new buildings totaling 8,400. Square feet. Each building will have a different use to support the religious activity the Temple. The usage are as follows:

  • Building B. Dining Room: Dinning and social gathering room

The Temple is open 24 hours seven days per week to general publics. As required by the Jogye order, the priest must stay in the premise 24 hours seven days per week for the public and members.

Our regular worship hours are 1st and 3rd Sunday every month from 10:00 am to 2:00 pm followed by vegetarian meals. From 2:00 pm to 5:00pm there will be counselling, meditation and social gathering.

As the Lead Agency, the County of Santa Clara will prepare an Environmental Impact Report (EIR) for the proposed San Martin Recreational Vehicle (RV) Park. The Notice of Preparation for the EIR contains a description of the project and a summary of the potential environmental effects.

Approval of the project will require actions by the County of Santa Clara, including the preparation and certification of an EIR and approval of a Conditional Use Permit, Architecture and Site Approval, and Grading Approval.

A Public Scoping/Community Meeting to solicit comments on the Notice of Preparation will be held in the Hiram Morgan Hill Room at the Morgan Hill Community and Cultural Center, 17000 Monterey Road, Morgan Hill, California, on June 6, 2019, from 6:00 p.m. and 8:00 p.m. In accordance with the California Environmental Quality Act (CEQA), comments on the Notice of Preparation are due by June 22, 2019. Project Description:

The project proposes to construct a 125-stall RV park with an approximately 6,900-square foot one-story lodge and 70 parking spaces for standard sized vehicles. The lodge would consist of a two-bedroom manager’s quarters, a lobby, café, conference room, storage rooms, laundry area, showers, and a service yard/storage area. Each RV stall would have utility hook-ups for water, electricity, and wastewater disposal. Wastewater from each stall would be piped underground to a lift station, which would pump it to an on-site treatment facility. Wastewater from the lodge would also be pumped to this facility, which would provide treatment and controlled distribution to three areas (leach fields) for subsurface drip dispersal at 8-10 inches deep.
