Description: The proposed project is an update of regulations governing individual on-site wastewater treatment systems within the unincorporated portions of the County. The project also includes updates to related sections of the General Plan and Zoning Ordinance.

File 10992 - General Plan and Zoning Ordinance Amendments Related to Minimum Parcel Size for Roadside Service Uses

The County is initiating a General Plan Amendment and a Zoning Ordinance Amendment that would establish a 5-acre minimum lot creation size for Roadside Services areas. The Roadside Services designation of the Land Use Chapter for the Santa Clara County General Plan (Book B) does not currently contain an allowable density policy for these areas. The current minimum lot size in the zoning ordinance is 20 acres [Table 2.50-2 in Section 2.50.030 (Development Standards)], which would be reduced to 5 acres under the proposed project. The proposed change to a 5-acre minimum lot size would enable the creation of three separate parcels in the Roadside Services designation at this location. No Roadside Service development is proposed as part of this 4-lot subdivision, which is further described under File No. 10700.

A public hearing is tentatively scheduled for the Planning Commission on July 27, 2017 in the County Government Center, Isaac Newton Senter Auditorium, 70 W. Hedding Street, San Jose, CA 95110. The Planning Commission will make recommendations to the Board of Supervisors regarding the adequacy of the Initial Study / Negative Declaration and whether or not to adopt the General Plan and Zoning Ordinance Amendments.

The 30-day Public Review period for the Initial Study / Negative Declaration begins on June 16 and ends on July 16. Public Comments regarding the correctness, completeness, or adequacy of the Initial Study / Negative Declaration are invited and must be received on or before the above date.  Such comments should be based on specific environmental concerns. File 10214: Giovannotto Land and Cattle Subdivision

Description: This application is for a two-lot subdivision of an existing 432.97 acre site. (See attached tentative subdivision map for details). The project will subdivide a parcel that fronts Whiskey Flat Road; Parcel 1 will be 352.97 acres and Parcel 2 will be 80 acres. The property is zoned AR (Agriculture Ranchlands), with 19.7% of it zoned AR-sr (Agriculture Ranchlands scenic road). Harrison Road, which runs through Parcel 2 of the proposed subdivision, will be widened in narrow areas, and paved and improved where necessary as required by Land Development Engineering standards, to provide access to the parcels. Some improvements on the access road have already been constructed which will be permitted as part of the conditions of the subdivision.
Once the property is subdivided, each lot could be developed with a single family residence, and secondary dwelling. Future home development would be served by well and onsite septic systems. However no residential development is proposed at this time.

Location: The parcel to be subdivided is located between Whiskey Flat Road and Pacheco Pass Highway west of Dinosaur Point Road adjacent to the Merced County Line with the rural unincorporated area of Santa Clara County, south and east of the City of Gilroy.

Description: Modification of use permit and architecture and site approval to construct expanded facilities associated with the Antiochian Orthodox Church of the Redeemer. The proposal includes a new two-story fellowship hall (17,634 sq. ft.) that would include assembly space, administrative offices, classrooms, and kitchen. The existing one-story hall (1,636 sq. ft.) and one-story office/ classrooms building (2,527 sq. ft.) would be demolished. The existing church building shall remain, and the parking lot will be expanded to accommodate as many as 91 vehicles. The school would primarily operate weekdays with a maximum occupancy of 81 students and 22 staff members. Grading quantities would include 2,069 cubic yards of excavated cut, and 272 cubic yards of fill. The requested modification would accommodate an ongoing annual weekend food festival that is currently authorized under entertainment event permits filed annually.

Location: 380 Magdalena Avenue, adjacent to the Interstate 280–Magdalena Avenue interchange. The project site is under the jurisdiction of Santa Clara County, and is within the urban service area of Los Altos.

Description: The proposed project is a Building Site Approval with Architectural Review (BA), Grading Approval, and Design Review Exemption for the development of a new single-family residence and associated improvements on slopes greater than 30%. The project has also been exempted from the standard Design Review procedures because of its proposed location being “not visible from the valley floor,” in accordance with Section 3.20.040 of the County Zoning Ordinance. The property owner proposes to construct an approximately 5,000 square-foot single-family residence with an attached garage. The estimated grading quantities for the proposed project are approximately 2,000 cubic yards of cut and 850 cubic yards of fill onsite, and an additional of 400 cubic yards of cut and 50 cubic yards of fill for offsite road improvement.

Description: The proposed project is a watershed maintenance program that would consist of activities intended to improve the operation of water supply facilities operated by San Jose Water company (SJWC) in the Los Gatos Creek Watershed. The location of the program area is the upper Los Gatos Creek Watershed from the confluence of Trout Creek and Los Gatos Creek north of the Lexington Reservoir Dam to the headwaters of Los Gatos Creek to the southeast (Location Map). Description: The proposed project would involve construction of new facilities at the William F. James Boys Ranch, an existing minimum security juvenile detention facility located in Morgan Hill. The new facilities would include an admissions / treatment / visitors center, a gymnasium building, and a dormitory as well as related infrastructure, such as parking spaces, driveways, covered walkways, and landscaping. The proposed project would also include demolition of the existing dormitory following completion and occupancy of the new one. The current James Ranch facility has a capacity of 84 beds. The expanded facility would accommodate up to 108 beds at full capacity.

Location: The subject property is a 150-acre parcel located at 19050 Malaguerra Avenue, Morgan Hill, CA.

Description: This application is for a Use Permit and Architecture and Site Approval to establish a new 100-foot tall telecommunications tower. The tower will be painted a neutral color to ensure minimal visibility to passersby. The proposed telecommunication facility will consist of a 2,500 square foot fence enclosed leasehold area with the monopole located within the leasehold area. Ancillary improvements include one (1) equipment shelter and one (1) 50 kilowatt standby propane generator. The proposed site will be surrounded by a 6-foot high chain-link fence. No grading will be necessary for the access road and minimal grading will be needed for the facility as a whole, insufficient to require a grading permit.
The proposed telecommunications tower will include the following components:

  • Twelve (12) eight foot tall panel antennas of which eight (8) will be centered at the 96-foot level and four (4) mounted at the 60-foot level
  • Ground-based equipment located within a 2,500 square foot leasehold area
  • Neutral matte color with a non-reflective finish

No trees will be removed for this project which will be accessed by an existing private road off Uvas Road.

Location: The subject property is a rural zoned, unincorporated, 11 acre parcel located at 15585 Uvas Road, ono-half mile west of Uvas Reservoir and approximately 5 miles southwest of the City of Morgan Hill.

File 2195 - Boulder Ridge Pool and Fitness Facility

The project was denied by the Board of Supervisors on February 10, 2015.

 

Project Description: The proposed project is modification of an existing Use Permit to allow construction of the fitness and swim center approximately 400 feet north of the existing clubhouse in the northeast corner of the golf club site. The fitness and swim center would involve construction of a 3-story fitness building, a 25-yard swimming pool, a smaller children’s instructional pool, parking spaces to accommodate users of the new facilities, and associated landscaping. The proposed building is approximately 19, 000 square feet in size and would include areas for locker rooms, fitness equipment, group instructional fitness classes, a juice bar, and a daycare center for children. The pool facility would be used for lap swimming and a competitive age group swimming program. The age group swim program would include daily work-outs and up to six annual swim meets. The proposed project would also include a County-initiated Zoning Ordinance Amendment to clarify the use of fitness and swim center in a golf club as an ancillary use. Additional language to clarify the ancillary use of a fitness center in a golf club would be further defined in the Zoning Ordinance and any accompanying guidelines.

Environmental Documents: The County is preparing an Environmental Impact Report (EIR) to evaluate the potential environmental impacts from the project, in compliance with the California Environmental Quality Act (CEQA). The County has published a Notice of Preparation announcing plans to prepare the EIR and requesting comments regarding information to be included in the EIR. On May 21, 2013, a community scoping meeting was held at Almaden Community Center for the purpose of providing information regarding the project and requesting feedback regarding the EIR scope.

Description: The proposed project is a Single Building Site and Grading Approval application for a 1,000 square foot single family residence with 200 square foot detached carport, 20,000 square foot covered horse arena, 6,533 square foot horse stable/barn, 840 square foot hay storage barn, and includes the existing 38,000 square foot open exercise arena and 1,200 square foot corral. Associated site improvements include a new septic system, driveway improvements, and horse trailer parking area. All proposed uses are for personal use and no commercial, industrial, or institutional uses are proposed. Grading for the project will include approximately 1,398 cubic yards of cut and 1,379 cubic yards of fill (total 2,777 cubic yards). No trees would be removed and no secondary dwelling is proposed.

The Santa Clara County Planning Office has prepared a Draft Environmental Impact Report (Draft EIR) for the development proposal described below. The 60-day public review period for this Draft EIR ended on April 9, 2017.

 


Project Description: The project site encompasses approximately 2,150 acres and is located approximately eight miles southeast of downtown San Jose, along Coyote Ridge in the Diablo Range. Two of the six legal parcels that make up the project site are located in unincorporated Santa Clara County (approximately 906 acres), while the remaining four parcels are located in the City of San Jose (approximately 1,244 acres). The project proposes developing 79 single family residences, 4 secondary units permanently preserved for affordable housing, potential for additional secondary units, a community center, and open space for the remaining 1,946.9 acres and associated roadway and utility improvements.

Project Location: Access is proposed from Silver Creek Valley Road at the northwest end of the site and Metcalf Road at the southern end of the site.

Background: On April 24, 2014, the Planning Commission determined that the Young Ranch Preliminary Development Plan for 30 home-sites and a community center was not in substantial conformance and/or inconsistent with the policies of the General Plan and Zoning Ordinance. Subsequently, on December 22, 2014, the applicant, YCS Investments (YCS) submitted a revised project as described above under Project Description, which includes a request to amend the Zoning Ordinance text amendment to authorize a transfer of density from the City of San José to unincorporated County of Santa Clara parcels. For this project, the County is in the environmental review process through the preparation of a Draft Environmental Impact Report (EIR).

Environmental Documents: The County will prepare an Environmental Impact Report (EIR) to evaluate the potential environmental impacts from the project, in compliance with the California Environmental Quality Act (CEQA).

    Location:
    The subject property is a 4.21-net-acre parcel (4.41 gross) located at 13920 Llagas Avenue. Within the rural unincorporated community of San Martin. The site is bordered by Llagas creek to the north and east, two commercial / industrial uses across Llagas Avenue, such as an automobile wrecking / recycling yard, to the West and an orchard with a single-family residence to the south. The San Martin transfer station is located on the parcel immediately north of Llagas Creek. Monterey Highway to the west, Murphy Avenue to the east and E. San Martin Avenue to the south are the major roads surrounding the property. The South County Airport is located approximately ¾ mile to the south.

    The property is developed with two warehouse buildings, an office building and a pole barn, as well as existing concrete and asphalt paving.     Description: The proposed project is a Use Permit, Architecture and Site Approval, and Grading Approval application for a 20-acre overflow and parking lot/automobile storage facility for an online automobile auction facility for Copart Inc. Associated site improvements include grading to control drainage and base rock for surfacing. The project includes fencing the lot to provide screening. Proposed use of the vacant lot is to store automobiles prior to their online sale. The facility will not be open to the general public. Employees of Copart will remain at the existing Copart’s location at 13895 Llagas Avenue, San Martin and will direct delivery of incoming vehicles to the proposed overflow yard. Once vehicles are received at the outdoor storage facility, they will be photographed and sold online to buyers. The proposed hours of operation will be Monday through Friday, 8:00 a.m. to 5:00 p.m. Grading for the project will include approximately 5,517 cubic yards of cut and 5,728 cubic yards of fill (total 11,245 cubic yards). There are no existing structures on the property and no structures are proposed. The proposed project entails removal of 53 Walnut and nut trees greater than 12” in diameter. A maximum of 8 vehicle trips will be generated per day through this use. Landscaping will be required as mitigation for visibility and in accordance with the adopted San Martin Integrated Design Guidelines.

    Description: Santa Clara County is proposing a modification to its ordinance code to protect stream water quality, riparian habitat, and wetland areas through a 30-foot riparian setback requirement for development within the San Martin Urbanized Area.     Description: The Local Agency Formation Commission (LAFCO) of Santa Clara County has approved three amendments to Saratoga’s Urban Service Area (USA). These amendments involve a retraction of the boundary of the USA to exclude lands from annexation consideration for a variety of reasons. The effective date of the urban service area retraction is June 30, 2013.
    The action of LAFCO requires the County to assign a General Plan land use designation and a General Plan-compatible zoning designation to these lands, as required by State law. The County is proposing to apply Hillsides General Plan and Hillsides (HS) Zoning designations to these areas.

    Location: The action of LAFCO affects three areas in the Saratoga foothills. (1) The On Orbit Drive area is a 92-acre area consisting of 27 Assessor Parcels located in the vicinity of On Orbit Drive.     The project includes a proposal to demolish 29 buildings with 414 beds, and construct 4 buildings with 2,434 new beds of graduate housing, ranging in height from 6 to 10 stories, for a net addition of 2,020 beds.

    The project includes a two-story pavilion, a market and cafe, and common amenities in each of the buildings such as social and community gathering rooms, activity rooms, computer clusters, and laundry facilities.

    The scope of the project includes the removal of 860 surface parking spaces, the addition of 186 new surface parking spaces, and the construction of a two-story underground parking structure providing 1,424 spaces, for 750 net new parking spaces.
