On May 23, 2017, the Santa Clara County Board of Supervisors adopted Zoning Ordinance amendments relating to secondary dwellings to update County regulations pursuant to the State’s Accessory Dwelling Units law. The Board adopted Ordinance No. NS-1200.360 with no changes from that which the Planning Commission considered and recommended at its April 27, 2017 meeting. The ordinance the Board of Supervisors adopted will go into effect June 22, 2017, 30 days from the date of adoption. The ordinance establishes a pipeline provision for permit applications to establish secondary dwellings based on state law provisions of CA Govt. Code Section 65852.2. State law provisions will continue to be in effect until the end of business day June 21, 2017. The pipeline provision is as stated below:
Complete applications for secondary dwellings received on or after January 1, 2017 and before the effective date of this ordinance shall be processed in accordance with Government Code section 65852.2 and shall comply with all other applicable County ordinances and standards.
