I was arrested on Felony charges, am I eligible for possible Own Recognizance (O.R.) release?

​New felony arrests that are not violent or serious felonies as defined in PC 1270.1 are eligible for possible O.R. release.
I was released from custody on O.R./Supervised O.R. but did not receive any paperwork. What should I do?

​Call the department of Pretrial Services immediately during regular business hours at (408) 918-7900 to find out information on release requirements and future court dates.
Where and what time can the defendant be picked up if he/she is granted a release on O.R./Supervised O.R.?

​Once the release paper work has been submitted to the County jail booking department, the Department of Corrections is in charge of the release process. Pretrial Services cannot provide a definite release time. 
What happens with the information I provide if I am not released on O.R.?

The information you provide will be placed in a confidential envelope in your court file. It may be used by judges to review for possible release consideration at a later date.
If I am not eligible for release, why should I still give my information to Pretrial Services?

Although you may not be eligible for release at the time of your arrest and booking, you may become eligible for release when you appear in court for your in custody arraignment. Additionally, circumstances may change that effect your eligibility at a future court date (i.e. warrants resolves, holds dropped, etc). 
Will I (the victim) be contacted if the defendant is released from custody?

​Not automatically, but you may request to be contacted. To sign up for the victim notification hotline you need to call 1-(800)-464-3568 and the defendant’s Personal File Number (PFN) or the exact spelling of their name and date of birth. You can also seek help and services by contacting the Victim/Witness Assistance Center at (408) 286-9663. I forgot my court date. Can you please tell me when and where I have to go to court?

If you are on O.R. or Supervised O.R., you may contact Pretrial Services at (408) 918-7900. Otherwise, Court information is available from the Department of Corrections’ Administrative Booking section at (408) 299-2306, or from the Santa Clara County Superior Court Clerk's Office. Court contact information is available at http://www.scscourt.org/general_info/contact/phones.shtml or in the Government Section of your local phone book. 
Can you tell me the bail amount of someone in custody?

​Bail information can be obtained by contacting the Department of Corrections’ Administrative Booking section at (408) 299-2306, or from the Santa Clara County Superior Court clerk's office. Court contact information is available at http://www.scscourt.org/general_info/contact/phones.shtml or in the Government Section of your local phone book.
I was arrested on Misdemeanor charges, am I eligible for possible O.R. release?

​New misdemeanor arrests that are not violent or serious felnoies as defined in PC 1270.1 are eligible for possible O.R. release.​
