Record Clearance

Following guidelines provided by the County of Santa Clara’s “shelter in place” orders and Governor Newsom’s executive order, the Superior Court of California, County of Santa Clara has suspended all non-essential functions until May 1, 2020 or such time as the orders are extended, rescinded, superseded, or amended. Consequently, we are not currently able to calendar Record Clearance applications or give a time estimate as to when they will be processed/heard by the Court. 


Adults (18 years of age and older) convicted of a crime may not have their record sealed.  Under certain circumstances the conviction may be set aside, and the case dismissed by the Court.  The record clearance does not keep the offense from serving as a prior conviction in a later criminal proceeding.  Court appearance and legal representation are not required, and the process may take up to six months.​
