Can you petition for me on behalf of another individual?
​The Public Guardian/Conservator does not petition on behalf of a private individual. Although an individual can file a petition themselves, it is highly recommended that a private legal professional is consulted for advice.

I have a power of attorney for health care and finances. Do I need to apply for a conservatorship?
​Those two documents may give you the same authorities as a conservatorship would, depending on the wording of the power of attorney for health care or finance document. It is recommended that a private legal professional is consulted for advice.

If my family member lives in another county can I file in Santa Clara County?
​The filing may only occur in the county of residence of the person being considered for conservatorship.

Can I be a co-conservator with the County?
​The Office of the Public Guardian does not file conservatorships with co-conservators.

Can emergency conservatorships be obtained?
Depending on the circumstances, such as health or financial risk, a court appointment can take up to 30 days for emergencies.
